However, it conceals hidden risks for the employee, in particular the risk of a waiting period of up to twelve weeks before receiving unemployment benefits. A thorough review and possibly legal advice are therefore essential.

However, for employees, such an agreement harbors numerous risks that are not immediately apparent. Careful review and, if necessary, legal advice are therefore strongly recommended.

A significant disadvantage of a termination agreement is the possible imposition of a waiting period for unemployment benefits. The Federal Employment Agency can impose a waiting period of up to twelve weeks, as the employee has contributed to the termination of the employment relationship by signing the termination agreement. This means that there is no entitlement to unemployment benefits during this period.

By concluding a termination agreement, the employee also waives their statutory protection against dismissal. This is particularly disadvantageous if the employee enjoys special protection against dismissal, for example due to pregnancy, parental leave, or severe disability. Even in cases where the employer could not legally terminate the employment relationship, the employee gives up their position by signing the termination agreement.
